North Carolina Learning Object Repository Acceptable Use Policy (AUP)

This NCLOR AUP is a guideline and is not an all-inclusive listing of impermissible conduct. The NCLOR reserves the right to change or modify all or any part of this AUP at any time. Subscriber acknowledges and agrees that NCLOR has broad authority to interpret and apply these Acceptable Use Policies, in its sole discretion.  NCLOR shall provide notice of any such modifications or amendments by email or by posting a new policy on the NCLOR website or blog.  Subscriber shall review regularly notices posted on‑line.

AUP – applicable to both Guests and Registered Users
The North Carolina Learning Object Repository (NCLOR) enables educators to locate, manage, and share K-20 learning materials within and across schools, colleges, universities, and state agencies.

Usage

This AUP describes the terms and conditions under which you may use the NCLOR.  Your access or use of the NCLOR or its content constitutes your acceptance of and agreement to be bound by these terms and conditions, including any policies and procedures incorporated by reference.

Each individual work in the NCLOR is offered for license to you by the creator of that work on the terms and conditions of its specific license.  You are required under U.S. copyright law, the equivalent laws of other countries, and international treaties to respect the copyrights of those creators and to use their works subject to the terms and conditions of their respective licenses and applicable law.  You may only copy, modify, distribute and otherwise use the works in the NCLOR in accordance with a license to do so or as may otherwise be permitted under applicable law.  You may not remove any copyright, trademark, or other proprietary notices from these works.
The NCLOR and its content are provided on an “as is” and “as available” basis, without any representations or warranties of any kind.  Users are solely responsible for all use or misuse of works accessed via the NCLOR.  Your use of the NCLOR is entirely at your own risk.  The NCLOR will not be liable for any damages of any kind arising from the use of this site, including, but not limited to, direct, indirect, punitive, incidental, and consequential damages.

If you are a North Carolina educator and would like to join the NCLOR community and submit or use NCLOR content, you must complete a registration form and obtain a personal account and password.  The NCLOR takes precautions to protect the personal information you provide from loss, misuse, unauthorized access, disclosure, alteration, and destruction. You are responsible and liable for maintaining the confidentiality of your password and account, and are responsible and liable for all activities that occur under your account through the use of your password.  Placing material in the NCLOR will not alter its previously existing copyright ownership status.

The NCLOR governing body may amend this Agreement at any time by posting the amended terms on the NCLOR website, and your continued use of the NCLOR following such modification shall be deemed to be your acceptance of any such modification.

You agree that the NCLOR may at its sole discretion and at any time terminate your access to and use of the NCLOR, or any part thereof, with or without notice.
In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect.

Objectionable Content

Content contributed to the NCLOR may not contain or be linked to any objectionable content.  Objectionable content can be defined as:

  • infringes upon any copyright, trademark, trade secret, or patent of any third party;
  • violates any obligation of confidentiality;
  • violates the privacy, publicity, moral or any other right of any third party;
  • is hateful or obscene;
  • is being used to harass, stalk, or otherwise threaten a person;
  • is libelous, defamatory, knowingly false or misrepresents another person;
  • is threatening, promotes violence, promotes discrimination (whether based on sex, religion, race, ethnicity, nationality, disability or age), promotes illegal  activities or otherwise contains materials that the NCLOR informs the user that it considers objectionable.

The NCLOR will determine what it deems objectionable under this AUP.

Contributions

When contributing resources, a user must:

  • ensure that all postings made by the user are original materials unless proper attribution is given to a third party;
  • not post any advertising or promotional content for themselves or any third party;
  • not accept any compensation from a third party for placing any content in a posting;
  • disclose all affiliations or relations necessary so that postings are not deceptive or misleading;
  • not knowingly link to any downloadable applications or other content which may be harmful to another user’s computer;
  • ensure that all opinions and statements are representative of the user’s honest views;
  • not offer legal, financial or medical advice;
  • ensure that resource(s) adhere by guidelines of  Section 508 of the Workforce Rehabilitation Act of 1973;
  • ensure that no Personal Identifying Information (PII) is added to any part of a contribution (i.e. Social Security  Numbers, Home Addresses etc.)
  • ensure that no student records (grades, assessments, etc.) are entered into a contribution.


General

Neither Subscriber nor Subscriber’s Users shall use the Services to stalk others, post, transmit, or originate any unlawful, threatening, abusive, fraudulent, hateful, defamatory, obscene, or pornographic communication, or any communication where the message, or its transmission or distribution, would constitute or would encourage conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law.

Subscriber and its Users shall not use the Service for any unlawful purpose. Without limiting the foregoing, Subscriber shall not permit its users to use the Services in violation of laws relating to copyright, trademark or libel/slander.

Unsolicited advertising by Subscriber or Subscriber’s Users is strictly forbidden

Any violation of this AUP allows the NCLOR to terminate Subscriber’s service.

Use of the Services for commercial activity is strictly forbidden.
